Following the success of our session last year, the Hamilton Locke Workplace and Safety team invites you to our upcoming WHS Due Diligence Mock Trial. This mock trial is suitable for senior leaders, safety practitioners and in house counsel in the private sector, as well as in the public sector.
This mock trial will be based on a real-world scenario and consider how a prosecution against an officer would unfold for a psychosocial hazard. This will be the same mock trial delivered in October 2025.
Under WHS Legislation, officers are required to acquire and keep up-to-date knowledge on WHS matters. With the increasing focus of regulators on emerging issues such as psychosocial hazards, there has never been a more important time for senior leaders to know and understand their obligations under WHS Legislation.
Our mock trial will provide detailed insights into the following:
- The duties and obligations of persons conducting a business or undertaking (PCBUs);
- The duties of officers of PCBUs;
- The meaning of due diligence;
- The six elements of officer liability; and
- Best practice in safety due diligence.
